Asbestos Compliance Audits

Once the Asbestos Management Survey report has been provided, there is then a duty under Regulation 4,  "Duty to manage asbestos in non-domestic premises",  Control of Asbestos Regulations 2012, to produce a written Asbestos Management Plan (AMP) and this should be reviewed annually.

To make effective use of Asbestos Management Survey, the supporting Asbestos Management Plan needs to identify how the information regarding the presence and condition of asbestos within the property or properties, is going to be effectively used  to safeguard and prevent staff, maintenance contractors and visitors from being exposed to asbestos in the course of their normal occupational activity within the site,

Due to the emphasis has been placed on the production of the Asbestos Management Survey, the preparation and effective implementation of an Asbestos Management Plan has often been part of the compliance component that has been overlooked.

For some organisation this has had dire consequences.

Two major retailers, Poundland and Jewson ( Stark Building Materials Ltd) have been prosecuted by the local authorities for falling to have either an effective asbestos management plans or failing to properly inspect and manage asbestos within their premises.

The fines were significant. Poundland was fined £565,000  and £75,000 in costs and the fine for Jewson was £400,000 and costs of £9.664.00.
